Out-of-Court Debt Recovery in Łódź

Before a case reaches court, there is often a simpler way to recover payment. Out-of-court, or amicable, debt recovery is the first and usually least expensive stage of collecting a debt — without court fees, bailiff enforcement or months of waiting for a judgment. KRS Kancelaria handles this work for businesses in Łódź and the surrounding region, combining effective pressure on the debtor with attention to something equally important to many businesses: preserving the business relationship with their trading partner.

This is where most cases begin within our comprehensive debt recovery service. We turn to court proceedings only when this stage proves unsuccessful.

Prevention Is Better: Safeguards in Your Contract

The most effective debt recovery begins before a debt arises. A well-drafted contract, with deadlines, late-payment penalties and security, makes subsequent collection simpler and faster. We therefore combine debt recovery with professional contract drafting and review, so that your contracts reduce the risk of payment delays from the outset.

Why Is a Demand from a Law Firm More Effective?

There is a measurable difference between sending a reminder yourself and receiving a letter from a law firm. Industry figures suggest that around 40% of debtors pay after the first demand from a law firm, compared with only around 15% after a demand sent directly by the creditor. Professionally managed amicable recovery succeeds in approximately 60–70% of cases. The reason is straightforward: a letter on a law firm’s headed paper tells the debtor that a professional is ready to take the case to court, which changes their assessment of the situation.

How Does Amicable Debt Recovery Work?

We begin with a review of the case: we verify the basis of the claim, the documents and the due date, and check whether the debt is time-barred. We then send the debtor a formal demand for payment — in writing, setting a payment deadline and explaining the further legal consequences. Depending on the case, we increase the pressure progressively: from an initial reminder, through a further demand, to a final demand before proceedings that clearly states our intention to take the matter to court.

At the same time, we maintain contact and negotiations with the debtor. Some debtors are not acting in bad faith but face temporary cash-flow difficulties. In such cases, negotiating a realistic repayment schedule, a deferral or instalments can be more effective than confrontation. The aim is voluntary payment, achieved more quickly and at lower cost than through a judgment.

05

Settlement and Security

Negotiations usually lead to a settlement setting out the repayment terms. Appropriate security is essential: a settlement that the debtor fails to honour must not become an empty promise. We therefore include provisions protecting the creditor and, in many cases, propose voluntary submission to enforcement in a notarial deed (Article 777 of the Polish Code of Civil Procedure). If the debtor stops paying, this allows the matter to go directly to a bailiff without the need for a court trial.

06

When Should Amicable Recovery End?

Amicable debt recovery has its limits. When a debtor ignores demands, avoids contact or may be disposing of assets, prolonging negotiations works in their favour: it gives them time to hide assets and brings the limitation deadline closer. In these situations, we recommend moving promptly to court debt recovery. As the same team handles the case from the outset, the transition is seamless and the documents already collected can immediately serve as evidence.
