What Is a Trade Mark?

A trade mark is a sign, usually a word, a combination of words and graphics, or a graphic, used in business to identify an undertaking’s goods or services. It helps distinguish the business from its competitors and make it recognisable.

The protection described here concerns signs registered by the competent authority: the Polish Patent Office for national registrations or the European Union Intellectual Property Office for EU registrations.

Registration gives the business the exclusive right to use the registered sign in a specified territory throughout the protection period, which lasts ten years and can be renewed for further ten-year periods.

Obtaining a registered trade mark helps reduce infringement risks  and makes enforcement easier if infringement occurs. This applies not only to using the mark to name goods or services or in conventional advertising, but also to use in internet domains and online campaigns such as SEO and Google Ads.
