Debt Recovery in Łódź

An unpaid invoice is more than missing revenue: it threatens the cash flow of a business that must still meet its own obligations. The earlier recovery begins, the better the prospects of payment, as delay increases the risk of assets being disposed of or the claim becoming time-barred. We handle recovery comprehensively, from amicable demands through court proceedings to enforcement, for businesses in Łódź, the region and throughout Poland.

Our approach differs from that of a typical collection agency. It begins with legal assessment of the claim and a practical strategy, rather than mass demands. You know from the outset whether and how recovery is possible and what it will cost.

01

Debt Recovery Step by Step

Effective recovery is an organised process. We begin with a review of the case: reviewing contracts, invoices and correspondence, checking limitation periods and assessing solvency. Only then do we propose a strategy, distinguishing a partner with temporary cash flow problems from one deliberately avoiding payment.

The next stages are amicable recovery, court proceedings and enforcement. Many matters resolve amicably. If that fails, we move to court and, after obtaining an enforceable title, enforcement. Dedicated pages explain each stage.

02

Amicable, Out-of-Court Recovery

This is the first and often effective step. Amicable recovery is cheaper and faster than litigation; straightforward, undisputed debts can sometimes be paid within 30 days of a demand. It includes a professional demand, contact and negotiations towards payment or settlement. A lawyer’s letter signals readiness for legal action more strongly than ordinary reminders. See out-of-court debt recovery.

Judicial Debt Recovery

When negotiation fails, we bring court proceedings to obtain a payment order or judgment — a basis for enforcement. For undisputed claims, we use faster procedures where appropriate, including electronic payment-order proceedings before the e-court. We prepare the claim, gather evidence and represent the business throughout. See judicial debt recovery.

04

Enforcement by a Court Enforcement Officer

A payment order is not the end: actual recovery matters. After obtaining an enforceability clause, we apply for enforcement and work with the enforcement officer, identifying the debtor’s assets. If the debtor is insolvent, we advise on further steps, including recovering from assets they attempted to conceal.

05

When Your Business Is Sued — Challenging a Payment Order

If your business receives a payment order it disputes, time matters: there are usually only two weeks to object, after which it becomes final. We assess the claim and prepare a defence. See objections to payment orders.

06

What Does Debt Recovery Cost and Who Pays?

This is a common question, with a useful answer. The debtor ultimately bears a substantial part of recovery costs. The losing party generally reimburses necessary litigation costs, including the court fee of 5% of the claim and legal representation at statutory rates. Creditors may also use other instruments to shift recovery costs to the debtor. Properly managed recovery is often largely at the debtor’s expense, which is one reason to involve a law firm.

07

Prevention Is Better Than Recovery

The least costly debt is one that never arises. Many payment problems result from unclear contracts and insufficient security. We therefore combine recovery with prevention through contract drafting and review , adding penalties, deadlines and security that can make later recovery easier. This forms part of our comprehensive legal support for businesses.
